The participant in Science Photogenic Competition 2023 ((hereinafter referred to as ‘contestant’) by submitting the photographs declares that he or she is the author of the submitted photographs therefore entitled to treat the photos within the meaning of the Act. no. 121/2000 Coll., as amended (the Copyright Act) and grant the organizer agreement with the use to the extent relevant for the purpose, content and aim of Science Photogenic 2023, namely promotion of science and research, and promotion of the Academy of Sciences and its institutions. The submitted photos must not violate the copyrights and personal rights of third parties. The contestant by submitting photographs to the contest also grants the organizers a non-exclusive agreement (licence) for the free use of the photographs thereof by any known means, at home and abroad, without limitation in amount for the entire duration of copyright ownership rights to his/her work. This agreement authorizes the organizer to publish and use the photographs in communication to the public in intangible form within the meaning of § 18 et seq. copyright law, including making the work in such a way accessible to anyone who may have access to the site and in time of their own choice (§ 18 par.. 2 of the Copyright Act), as well as the reproduction of the photograph for this purpose in unlimited range; i.e. distribution within the meaning of § 14 of the Copyright Act and repeating in periodical or non-periodical publications, and to any extent (number of copies) as well as reproduction within the meaning of § 13 of the Copyright Act in unlimited extent for the purpose of such publication (distribution) and exhibition. The organizer is authorized to license the use of the photographs to third parties in the same extent without any further consent.
By submitting the photographs, the contestant also declares that if any picture of any person in the photograph is captured in an identifiable form, the contestant has acquired the persons’ agreement with being captured on the photograph which can be reproduced and circulated by any means mentioned here. Further, by submitting photos to the contest the contestant confirms that he/she has properly settled claims by third parties relating to the personal rights and personal privacy and property rights in accordance with generally binding legal regulations, in particular Act. no. 89/2012 Coll., the Civil Code, Act. no. 121/2000 Coll., as amended (the Copyright Act), and Act. no. 110/2019 Coll., as amended (the Act on the Protection of Personal Data). The contestant by submitting photographs confirms that he/she agrees without reservation to the conditions set out in the rules and conditions of the competition Science photogenic 2023.
